Marin judge sets trial in family homicide case

A judge has set Oct. 21 as the first day of trial for a San Rafael woman charged with murdering her mother.

Tonatzyn Oris Beltran, 30, has pleaded not guilty by reason of insanity. Beltran is accused of stabbing Olivia Beltran, 55, at the victim’s apartment on Cresta Way in January 2024.

San Rafael police found Beltran standing with a knife in her hand on a balcony while her mortally wounded mother lay next to her. Police said Beltran broadcast the attack live on social media. Her mother died at a hospital.

Last month, Judge Geoffrey Howard declared Beltran competent to stand trial after reviewing mental health evaluations. Howard set the trial date on Wednesday.

“It is truly a shame that despite the overwhelming evidence that Ms. Beltran was in an acute mental health crisis and legally insane at the time of this tragedy, the District Attorney’s Office is resisting the calls of the victims and the community to send her to a hospital for long-term care,” said Matthew Siroka, her defense attorney.

District Attorney Lori Frugoli said the office does not comment on cases that are active in court.
